MUMBAI: The Maharashtra Real Estate Regulatory Authority (Maha-RERA), for the first time, imposed fines on seven developers for advertising their housing projects without mentioning the MahaRERA website and registration numbers as per norms.
On a complaint filed by the Mumbai Grahak Panchayat, a fine of Rs 2 lakh each was imposed on – Goodtimes, Rikki Ronie, Ashar Realtors, Puraniks, Lashkaria Housing Sandeep Landge and Kabra & Associates. Kabra & Associates were fined an additional penalty of Rs 10 lakh for falsely advertising that the registration process for its Juhu Chandan project was on when the project was not registered with MahaRERA.
“Advertising unregistered real estate projects, and advertising them along with registered projects is a violation of section 3 of RERA. Similarly, not displaying MahaRERA online portal address as well as only mentioning MahaRERA registered without mentioning the registration number are both violations,” said Shirish Deshpande, president, Mumbai Grahak Panchayat (MGP)
He said MGP activists monitored advertisements in newspapers, websites of promoters, and also collected promotional material displayed at property exhibitions. “Our volunteers found several unregistered projects being openly advertised, marketed and sold in brazen violation of Section 3 of RERA. We have submitted a list of 31 such ads to MahaRERA chairperson today,” he said.
“We also found them publishing disclaimers in their ads saying that they reserved the right to alter plans, layout amenities etc. at a later date without prior notice. Rules do not allow promoters any alterations once they are registered with MahaRERA without the consent of 2/3rd of allottees of that project. Such disclaimers defeat the authority of RERA,” Deshpande added.
The list of 31 includes ads by prominent developers like Kabra & Associates, Karrm Infrastructure Pvt Ltd have reportedly falsely advertised unregistered projects along with registered ones.
Ads of Haware Paradise project in Kalyan did not have the stipulated MahaRERA website name, while real estate agent Softcorner was found advertising ten unregistered projects in Karjat, Neral, Panvel, Shahapur, Asangaon, Dombivali, Igatpuri, Murbad, Talegaon, and Khandala at the Thane property exhibition.
In his complaint to MahaRERA, Deshpande has said that such ads have been appearing for a long time and demanded that such promoters be penalised at least 5 to 10 per cent of the project cost as mandated by Sections 61 and 59 of RERA respectively.
